These Terms of Service (“Terms”) govern your use of the Pollen Count website at pollencount.org and the Pollen Count mobile application (together, the “Services”), operated by Pollen Count UK (“we”, “our”, or “us”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Services.

1. Not medical advice

The Services are provided for general informational purposes only. Pollen forecasts, species data, symptom diary analyses, and any other content provided through the Services do not constitute medical advice, diagnosis, or treatment.

You should not rely on information provided by the Services as a substitute for professional medical advice. If you suffer from allergies, asthma, or any other medical condition, you should consult a qualified healthcare professional before making decisions about your health, medication, or activities based on pollen forecast data.

If you are experiencing a medical emergency, contact your local emergency services immediately.

2. Accuracy of forecasts and data

Our pollen forecasts are generated using atmospheric transport modelling and other computational methods. While we strive for accuracy, all forecasts are estimates and are subject to inherent uncertainty. Actual pollen conditions at any given location and time may differ from our predictions due to factors including (but not limited to) localised weather variations, land use changes, and limitations of the underlying models and data sources.

We do not guarantee the accuracy, completeness, or reliability of any forecast, pollen count, species identification, or other data provided through the Services. You use this information at your own risk.

3. Use of the Services

You may use the Services for personal, non-commercial purposes in accordance with these Terms. You agree not to:

  • reproduce, redistribute, or republish our forecasts, data, or other content without our prior written consent;
  • use automated tools (including scrapers, bots, or crawlers) to extract data from the Services, except as permitted by our robots.txt file;
  • attempt to interfere with, disrupt, or place an undue burden on the Services or their underlying infrastructure;
  • use the Services for any purpose that is unlawful or prohibited by these Terms;
  • misrepresent the source of any data obtained from the Services.

4. Intellectual property

All content on the Services — including text, graphics, logos, data, software, and forecast outputs — is the property of Pollen Count UK or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on our content without our prior written consent, except for reasonable personal use such as viewing forecasts for your own reference.

5. Third-party links and content

The Services may contain links to third-party websites, applications, or services (such as app stores). We do not control and are not responsible for the content, privacy practices, or availability of these external resources. The inclusion of any link does not imply endorsement by Pollen Count UK.

6. Advertising and cookies

The Services may display advertisements provided by third-party advertising networks, including Google AdSense. These networks may use cookies, web beacons, or similar technologies to collect information about your browsing activity in order to serve relevant advertisements.

For users in the European Economic Area, the United Kingdom, and Switzerland, we use a consent management platform to obtain your consent before placing non-essential cookies, in accordance with applicable data protection laws. 7. User-generated data

If you use features such as the symptom diary, any data you enter is processed in accordance with our Privacy Policy. Symptom diary analyses (including trigger identification and confidence scores) are generated algorithmically and are not reviewed by a medical professional. See Section 1 regarding the limitations of this information.

8. Availability and changes

We reserve the right to modify, suspend, or discontinue the Services (or any part of them) at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Services after changes to these Terms constitutes acceptance of the revised Terms.

We do not guarantee that the Services will be available at all times or that they will be free from errors, interruptions, or security vulnerabilities.

9. Limitation of liability

To the fullest extent permitted by applicable law:

  • The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Pollen Count UK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Services.
  • Our total aggregate liability to you for any claims arising from or related to the Services shall not exceed £100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under English law.

10. Indemnification

You agree to indemnify and hold harmless Pollen Count UK, its officers, and its contributors from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your use of the Services or your breach of these Terms.

11. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
